Guidance on Political Activity at Barnard

With the presidential campaign season upon us, it is useful to remind the College community about the restrictions on political activity that apply to Barnard as a tax-exempt, not-for-profit organization.

Any restriction on freedom of expression at an educational institution seems unusual. However, the U.S. Internal Revenue Code and relevant regulations strictly prohibit organizations such as Barnard, that are able to receive tax-deductible contributions, from engaging in partisan political activity on behalf of any political party or candidate for public office. Political intervention is defined broadly, and includes financial contributions, campaign events, and written or oral statements in support of or in opposition to a particular candidate. Violations of that prohibition could jeopardize the College's tax-exempt status.

To insure that Barnard does not inadvertently put its tax-exempt status in jeopardy, members of the College community must use caution when participating in national, state or local political campaign activities. Please take note of the following:

  • When taking a position on a candidate for political office or taking a position on an issue for the purpose of assisting or opposing a candidate, individuals and groups at Barnard must speak only for themselves, and must make clear that they are not representing the College.
  • Employees may not engage in political activities during work hours or on College property.
  • The College's resources may not be used for political purposes or in support of a political candidate or campaign. These resources include, but are not limited to, copiers, fax machines, letterhead, telephones, computers, mail privileges, mailing lists, the College Website and any related message boards or forums, and other College-owned facilities, systems or equipment.
  • Barnard's name or insignia cannot be used for any political purpose, nor may funds or other contributions be solicited in the name of Barnard College for political support or carrying on a political campaign.

Certain nonpartisan political activities, such as voter registration activities, voter education programs and candidate debates may be permitted. Permission for these types of events must be obtained from the Office of the General Counsel.
